Acceptable User Policy (AUP) Agreement
for LGA Anti-Spamming Email Filtering Service (EFS)
This Agreement is between LGA Telecom Pte Ltd ("LGA") and the Customer to determine the acceptability of using LGA Anti-Spamming Email Filtering Service ("Service") according to the terms and conditions in this Agreement.
Maintenance and Support
LGA technical team shall perform the updates and maintenance of the Service on an automitically and regular basis. Upon purchase of the Services, the Customer is provided with telephone technical support only.
Should the Customer need additional onsite assistance for any of our services, our Managed Security Service team offers a wide range of flexible, hands-on support services at a reasonable fee.
No Warranty and Disclaimers
The Service is provided "AS IS" and without warranty of any kind, either express or implied, including but not limited to, any implied warranties and merchantability or fitness for a particular purpose or warranties of quality or performance.
In no event shall LGA be liable for any direct, incidental, special, exemplary, or consequential damages (including, but not limited to, procurement of substitute goods and services; loss of use, data, or profits; or business interruption) however caused and on any theory of liability, whether in contract, strict liability, or tort (including neglience or otherwise) arising in any way out of these Services, even if advised of the possibility of such damage.
LGA does not warrant that: (a) operation of any of the Software Updates shall be uninterrupted or error free, (b) that functions contained in the Software Updates shall operate in combinations which may be selected for use by Licensee or meet Customer's requirements, or (c) that the Software will detect all spammed mails or other software routines or hardware components designed to permit unauthorized access to or to disable, erase or otherwise harm any software, hardware or data.
Governing Law and Jurisdiction
This agreement shall be governed by the laws of Singapore and the parties submit to non-exclusive jurisdiction of the Courts of Singapore.
By using the Services, you, as the Customer, agree that you have read this agreement, understand its terms, and agree to be bound by its terms and that it is the only agreement between us, subject to amendments, regarding the services and documentation. If you do not agree to all of the terms of this agreement, do not use the services.
